 Equipment
Choice :
LocaCentre will not be liable
for the equipment choice made by the lessee.
Proposal
limit of validity :
Our proposal stay valid
as long as we keep the stock disponibility.
Date changes, forfeiture :
For any change in the scheduled
date made in between 30 and 15 days before the service date, a cancellation
indemnity of 30 % of the total amount of
the service would be due.
For any change
in the scheduled date made 15 days or less before the service date,
the total amount of the service would be due.
Safety deposit :
A safety deposit equal to
the price of the new equipment will be required. Ownership: the equipment
shall remain the exclusive property of LocaCentre and may not be moved
or assigned.
Property
:
All equipments rented by
LocaCentre stays our exclusive property, and cant be solded.
Use
of equipment :
The lessee and its personnel
state that they are familiar with the operation of the equipment rented.
Internet
and network settings :
Internet
and network settings would be completed only if the lessee provide all
the related informations as phone configuration, network settings and
software if needed.
Obligations of the renter :
With respect to LocaCentre
the lessee shall be solely liable for any possible damage, loss or theft.
The lessee shall take any useful measure, at its discretion, to cover
itself against any risk of damage, loss or theft, and in general against
any loss or hazard.
Maintenance
:
Maintenance is included
in the lease price and shall be performed either by a return to the workshop
for repair or via exchange if delivery was not performed by us or via
the delivery of replacement equipment.
Payment :
The payment delai is mentionned
on our proposal. The reception of a check, bill of exchange or instrument
shall not be considered as paid until LocaCentre has been credited for
the amount due.
In the event
payment deadlines are not complied with as described above, collection
expenses shall be paid by the customer. The sums remaining due may be
subject to late penalties equal to 1.5 times the legal interest rate.
Penal clause:
En outre, le défaut de règlement
aux échéances entraîne de plein droit, à titre de clause pénale, et après
mise en demeure par lettre recommandée avec accusé de réception d'avoir
à s'exécuter dans les huit (8) jours restée sans suite, le paiement d'une
pénalité égale à 5 % des sommes restant dues avec un minimum de 75 euros.
Liability :
LocaCentre may not in any
event be held liable for any damage of any type whatsoever, notably operating
losses, loss of data or any other loss resulting from the use or the impossibility
of using the leased equipment.
Disputes :
Our relationship
with you is of utmost concern to us. Hence we feel it is important to
have a framework to settle any possible differences that might arise.
Any dispute or claim shall be handled by the competent Paris courts.
